Terms of Rental and Use – Small World

1. General

1.1. Advanced Satellite Location Services Ltd., Company No. 514051788 (hereinafter: “Small World”), rents various satellite communication devices that operate using different methods and across different commercial satellite communication networks, and develops/purchases unique software, in order to provide our customers with a variety of devices and sulutions for their various needs and those of their family members (such as an advanced data management application for travelers, a mobile application, and a web application for those staying at home).
1.2. It is important to know, as detailed in the rental terms below, that there is dependence on environmental conditions and on third party services, including with respect to satellite communication infrastructure, hardware, and software, and malfunctions that may occur beyond the contrul of Small World.
1.3. Placing the order constitutes your consent to all the terms detailed below.

2. The customer

2.1. The customer is the person placing the order and is not permitted to transfer the device to others. In any case of transferring a device to others, the customer shall be liable to Small World for any damage and expense incurred by it as a result.

3. The device

3.1. The satellite communication device and any accessory that was rented to the customer.

4. The country in which the device will be used

4.1. Small World rents satellite communication devices for global use and irrespective of the destination declared on the order form or any information in writing or orally provided to Small World’s representatives.
4.2. It is the sule responsibility of the renter to verify in advance that the use of the device is legal and permitted in the countries in which he intends to use it.
4.3. Small World does not track the legality of satellite communication in different countries and cannot be responsible for any complaint or action taken against the customer by the authorities in any country in which the device is used.
4.4. Likewise, Small World does not undertake to inform its customers regarding the legality of using satellite communication devices in different countries. In general and without any commitment that this is so, in effect at the time of renting the device or at the time of its receipt, some of the countries in which the use of satellite communication may be prohibited or require special authorization: India, North Korea, Cuba, Burma, Bangladesh, China, Libya, Nigeria, Sudan, Sri Lanka, Russia, Chad, Jordan, Ethiopia.
The customer shall not be entitled to receive any refund or compensation from Small World in the event that lawful use of the device cannot be made in any country.

5. The devices

5.1. Small World is not the manufacturer of the devices that it rents to its customers, and it purchases from various manufacturers the devices, accompanying accessories, support services, accompanying applications, and everything related to the proper operation of the device. It is emphasized that the operation of the devices that Small World rents to its customers is entirely dependent on services provided by the manufacturers of satellite communication devices (for example Garmin, Iridium, Inmarsat, Globalstar, etc.) and the satellite network in which they operate.
5.2. A device delivered at the time of rental is previously checked to be apparently in working order, tested by sending a message and verifying the successful transmission, reception in the system, and display in the travel log. After placing the order, the customer receives by SMS and to the email address provided when placing the order a link to instructions on how to perform the test himself. Beyond the test conducted by Small World, the customer is responsible for performing the test according to these instructions upon receipt of the device and for verifying its proper functioning.

6. Small World is not responsible

6.1. For problems and malfunctions in the device, including software malfunctions on the manufacturer’s side, malfunctions resulting from software and hardware updates performed by the manufacturers in the devices, and other unforeseen issues in the device during the rental period.
For communication availability, non delivery of messages or non display of locations, or any other failure resulting from malfunction of the device manufacturer and the infrastructure it provides.
For communication failures and various technical malfunctions resulting from the manner of use of the device or terrain conditions (such as operation not in accordance with the manufacturer’s instructions or instructions provided by Small World, humidity, sand, physical damage to the device, weather, lack of reception due to physical obstructions or topography, and the like).
6.2. If a malfunction is found in the device, the renter is responsible for returning the device to a Small World representative for inspection. If it is found that the device is defective, a replacement device will be provided to the renter. In such a case, the renter is not entitled to any refund or compensation for this or for any result arising therefrom.

7. The satellite communication infrastructure

7.1. As stated, the devices connect to satellite communication infrastructure that is not owned or contrulled by Small World. The company purchases various services from satellite communication companies and is dependent on them for the provision of the service, and therefore it is not able to guarantee service availability.
7.2. Accordingly, Small World bears no responsibility in the event of unavailability of satellite communication whether for short or long periods and does not perform ongoing monitoring of the availability of network communication services.

8. The website, Travel Log application, and Travel Log mobile application

8.1. Small World provides the option to store locations and messages in a database, to display locations and messages in Small World’s various applications, and to distribute messages to mailing lists.
8.2. For the purpose of distributing messages and locations, Small World uses external services and is not responsible for malfunctions arising from unavailability or poor operation by the relevant external service providers (including email distribution service, SMS distribution service, email reception and push service as encoded text, etc.).
8.3. In order to store, display, and distribute messages and locations, Small World uses external server and database services with high international standards and proper and professional management and backup. Small World is not responsible for any malfunction resulting from unavailability of servers and databases.

9. Availability of Small World representatives to respond to inquiries

9.1. Small World operates an emergency center with 24 hour response via a landline, as well as an additional backup center via a cellular line.
9.2. Nevertheless and despite the backup, Small World’s ability to provide a human telephone response to inquiries 24 hours a day depends on the availability of the external services listed above and on the availability of the cellular network and landline infrastructure. Small World is not responsible for the unavailability of its representatives due to a malfunction at external service providers or a technical malfunction in these infrastructures and communication devices.

Terms of Rental and Use – Small World

10. Rescue and evacuation services

10.1. It is the sule responsibility of the customer to arrange insurance and purchase rescue and evacuation services appropriate to the activity he is going to carry out during the period of renting the device from Small World.
10.2. Small World is not responsible for the existence of rescue and evacuation services and does not itself provide rescue and evacuation services or rescue and evacuation insurance services to its customers.
10.3. Small World provides the communication device and a supporting system for receiving and distributing messages and for contacting the insurer and rescuers in an emergency. It is the renter’s responsibility to operate the device he rented, to make contact, and to actually communicate with the insurance company and the rescue and evacuation services.
10.4. Small World has no business relationship or any obligation with the various rescue and evacuation companies and insurance companies. Small World is not responsible for their availability and reliability and the quality of their service and operation. The customer is directly responsible for any rescue and evacuation operation required during the rental of the device from Small World.

11. Cancelation,damage to the device, delays in returning the device, and additional terms

11.1 Cancellation of an order before the collection day - no charge will be made and if the order was charged, a refund will be made for the entire amount.
Cancellation of an order on the collection day for a satellite messenger (Ineritz Mini, Ineritz Explorer, Messenger Plus, Zollo) - no charge.
Cancellation of an order on the collection day for a satellite phone (Iridium 9555, Iridium 9575, Inmarsat Eastphone) - a charge of 75 NIS will be made. If the order was charged, a credit will be made for any amount in excess of 75 NIS that was charged.
Cancellation of an order on the collection day for a satellite internet modem (Go Exec) - a charge will be made according to the minimum order as stated in the product price list.
11.2 It is the renter's responsibility to return the device to Small World to the return point specified in the order at the end of the rental period.
11.3 Loss or damage - In any case of loss or damage to the device or accessories, Olam Katan reserves the right to charge the deductible detailed in the price list published on the company's website.
11.4 Delay - In the event of an uncoordinated delay in returning the device, Olam Katan will be entitled to charge the daily cost for failure to return the device, according to the cost published on the website, in the rental form and in the device order documents.
11.5 Airtime, messages and data - Olam Katan reserves the right to charge for airtime or messages and data consumed in accordance with the rental terms of the device detailed in the price list on the website, in the rental form and in the order documents.
11.6 The customer hereby authorizes Small World to charge the credit card provided at the time of placing the order for all of the above charges, as applicable.

12. Use of the device – Privacy Pulicy

12.1. The use of the device is subject to the Privacy Pulicy published on the company’s website, and its use constitutes the customer’s consent to its contents, to the cullection of information and its use as detailed therein.
